It is the intention of this privacy statement to explain to you the information practices of Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training in relation to the information we collect about you.

Why are we processing your data? Our legal basis

In order for us to provide you with safety training, consultancy and recruitment services Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training need to collect personal data for statutory records and communication.
Our reason (lawful reason) for processing your data under the GDPR is:

  1. Cohort Candidate

The Personal Data will be requested, stored, processed, used and disclosed by the Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training to:

  • Evaluate data about you against vacancies which we may have that we determine may be suitable for you. In line with the nature of recruitment services, we will keep your data on our database with your consent.
  • Send your information to our clients to put you forward as a candidate for vacancies or to assess your eligibility for vacancies that we may have with your permission. When your information is sent to a client, we will automatically notify you by email when this has been done, to which client it has been shared and for what specific purpose so that you know where else your data has been submitted and stored.
  • Permit you to submit your CV to apply online for jobs.
  • Communicate with you about relevant job opportunities, provide career guidance and support, and request your feedback on your candidate experience.
  • Where we have a bona fide requirement by law to disclose it to third parties in relation to the detection of crime, the collection of taxes or duties, in order to comply with any applicable law and court orders.
  • Third-parties where we or our client have engaged them to deliver services that have been requested. These may include references, qualifications, criminal reference checking services and/or psychometric evaluation or skill tests. These will be advised to you as part of the process and you have the option to decline.
  1. Cohort Employee

For people being employed and contracted by Cohort, additional Personal Data to Candidate Data is also required to facilitate employment, compliance and payment services, such as bank account details, national identification numbers, tax clearance and visa details. This data will only be held for as long as it is required to provide such employment services and will be deleted once your employment has finished and data is not required for any other legal purposes.

  1. Cohort Contractor

For people being contracted by Cohort, additional Personal Data to Candidate Data is also required to facilitate employment, compliance and payment services, such as bank account details, national identification numbers, tax clearance and visa details. This data will only be held for as long as it is required to provide such employment services and will be deleted once your employment has finished and data is not required for any other legal purposes.

  1. Third Party Supplier Candidate

In the fulfilment of some of our Client service contracts, we act as a Master Supplier for recruitment services which requires us to process candidate CVs and worker details from other recruitment providers on behalf of our client. In this case the data processed is specifically for this client’s application/ placement and is not available or used for the purpose in section (i) of finding career opportunities for Cohort Candidates. If such a third party candidate is unsuccessful with their application, then the candidate details are removed from the system. Similarly, once the placement is completed, this personal data is removed from our systems

  1. Client Contact

To enable Cohort to provide recruitment services to your employer, we will process and store client contacts details, which would include name, work contact details, job title and job activity history. Once added to our contact database, you will receive notification of this and you will at all times have the ability to be deleted and/or to opt out from electronic communication

  1. Marketing Contact

You may be added to our list of marketing contacts either as a marketing contact only or in addition to other contact types on this list. If you share your email address or other contact details with us and consent to receive marketing communication, we will use your personal data to communicate with you directly with useful information, advice, and support materials through email, messaging, or mobile/web notification. We will only contact you via methods that you approve directly and will only send you content that you have requested directly or consented to receive. As a marketing contact your data will be held only for as long as you consent to receive communication from us, you will always have the freedom to unsubscribe from some or all contact from every message.

This Personal Data list is not exhaustive and we may seek to process, use or disclose your information for any other purpose which has not been listed above always with your explicit consent.

Your information will only be used to provide you with an efficient service, this information may be shared within Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training.

How will Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training use the personal data it collects about me?

Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training will process (collect, store and use) the information you provide in a manner compatible with the EU’s General Data Protection Regulation (GDPR). We will endeavour to keep your information accurate and up to date, and not keep it for longer than is necessary.

Special categories of personal data

If we collect any special categories of personal data (e.g. health, religious beliefs, racial, ethnic origin – financial information is not classified as special categories of personal data) – we will ensure the below

  • we will obtain your explicit consent

Who are we sharing your data with?

We may pass your personal data on to third-party service providers contracted to Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training in the course of dealing with you. Any third parties that we may share your data with are obliged to keep your details securely, and to use them only to fulfil the service they provide on your behalf. When they no longer need your data to fulfil this service, they will dispose of the details in line with Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training procedures.

If we wish to pass your sensitive personal data onto a third party we will only do so once we have obtained your explicit consent, unless we are legally required to do otherwise.

The third parties that we pass your personal data to are:

  • our CRM providers
  • accountants
  • statutory agencies

We have issued all our third party processors with a Data Processor checklist asking them GDPR specific questions

If we transfer personal data to a third party or outside the EU we as the data controller will ensure the recipient (processor or another controller) has provided the appropriate safeguards and on condition that enforceable data subject rights and effective legal remedies for you the data subject are available.

Data subject rights:

Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training facilitate you, our clients, rights in line with our data protection policy and the subject access request procedure. This is available on request.

  • Right of access: you have the right to request a copy of the information that we hold about you.
  • Right of rectification: you have a right to correct data that we hold about you that is inaccurate or incomplete.
  • Right to be forgotten: in certain circumstances you can ask for the data we hold about you to be erased from our records.
  • Right to restriction of processing: where certain conditions apply to have a right to restrict the processing.
  • Right of portability: you have the right to have the data we hold about you transferred to another organisation.
  • Right to object: you have the right to object to certain types of processing such as direct marketing.
  • Right to object to automated processing, including profiling: you also have the right to be subject to the legal effects of automated processing or profiling.
  • Right to judicial review: in the event that Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training refuses your request under rights of access, we will provide you with a reason as to why.

All of the above requests will be forwarded on should there be a third party involved as we have indicated in the processing of your personal data.

Retention of your personal data

Data will not be held for longer than is necessary for the purpose(s) for which they were obtained. Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training will process personal data in accordance with our retention schedule. This retention schedule has been governed by our internal governance.

In the event that you wish to make a complaint about how your personal data is being processed by Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training or how your complaint has been handled, you have the right to lodge a complaint directly with the supervisory authority and Horticulture Ireland (Solutions) Ltd. T/A Cohort Recruitment & Training data protection representatives Data Protection Officer / GDPR Owner

If we are collecting your data for a contract and you cannot provide this data the consequences of this could mean the contract cannot be completed or details are incorrect.

Additional Processing

If we intend to further process your personal data for a purpose other than for which the data was collected, we will provide this information prior to processing this data.
